  • YOUR RIGHTS WITH RESPECT TO YOUR HEALTH INFORMATION
  • HOW TO FILE A COMPLAINT CONCERNING A VIOLATION OF THE PRIVACY OR SECURITY OF YOUR HEALTH INFORMATION, OR OF YOUR RIGHTS CONCERNING YOUR INFORMATION

YOU HAVE A RIGHT TO A COPY OF THIS NOTICE (IN PAPER OR ELECTRONIC FORM) AND TO DISCUSS IT WITH our Clinical Director AT (206) 339-0233 AND contact@teleclarity.org IF YOU HAVE ANY QUESTIONS.

Clarity Healthcare (also referred to as “Clarity,” “we,” “us,” or “our”) provides telehealth mental health and substance use disorder treatment, including Partial Hospitalization (PHP) and Intensive Outpatient (IOP) programs, to individuals in the State of Washington through teleclarity.org.

Overview of This Policy

This Privacy Policy has five sections:

  • Notice of Privacy Practices. How we use and disclose your protected health information (PHI), your rights as a patient, and our legal duties under the Health Insurance Portability and Accountability Act (HIPAA).
  • Substance Use Disorder Records. Added protections for records covered by the federal confidentiality rules at 42 CFR Part 2.
  • Website Privacy. How we handle information collected through teleclarity.org, including forms, cookies, and analytics.
  • Consumer Health Data Privacy Policy. Your rights under the Washington My Health My Data Act (RCW 19.373). This policy sits on its own page.
  • General Provisions. Washington health information law, security, breach notice, record retention, minors, text messages, and nondiscrimination.

If you have questions about this policy, contact our Privacy Officer using the information in the Contact Us section below.

Notice of Privacy Practices (HIPAA)

This section explains how we use and share your health information and what rights you have.

Our Legal Duties

We are required by law to:

  • Maintain the privacy and security of your protected health information (PHI).
  • Give you this notice of our legal duties and privacy practices.
  • Follow the terms of the notice currently in effect.
  • Notify you promptly if a breach occurs that may have compromised the privacy or security of your information, including your substance use disorder records.

We will not use or share your information other than as described here unless you tell us we can in writing. You may change your mind at any time by letting us know in writing.

How We May Use and Disclose Your Health Information

Treatment. We use your information to provide, coordinate, and manage your care. For example, your therapist, psychiatric provider, and care team share information to build and adjust your treatment plan, including medication-assisted treatment (MAT).

Payment. We use and share your information to bill and get paid by health plans and other payers. For example, we share information with your insurance company to verify benefits, obtain authorization, and submit claims.

Health Care Operations. We use your information to run our practice, improve quality of care, train staff, and conduct audits and licensing or accreditation reviews.

Business Associates. We work with vendors who perform services for us, such as secure video platforms, electronic health record systems, billing services, and IT support. They must sign a Business Associate Agreement and protect your information as required by HIPAA.

Other Uses and Disclosures Permitted or Required by Law

We may share your information without your authorization when:

  • Required by federal, state, or local law.
  • Needed to prevent or reduce a serious and imminent threat to the health or safety of you or others, including warning an identifiable person when Washington law requires it.
  • Reporting suspected abuse or neglect of a child or vulnerable adult as required by Washington law (RCW 26.44 and RCW 74.34), and reporting domestic violence where the law allows.
  • Responding to public health activities, health oversight audits, or investigations.
  • Responding to a court order or lawful subpoena, subject to the additional limits in the Substance Use Disorder Records section below.
  • Working with a medical examiner or coroner.
  • Addressing workers’ compensation claims, as permitted by law.
  • Responding to requests from law enforcement or for specialized government functions, as permitted by law.

Washington Protections. Washington law gives added protection to mental health treatment information and to information about sexually transmitted diseases, including HIV. We share this information only as Washington law allows, even when HIPAA would allow more.

Uses Requiring Your Written Authorization

We will never do the following without your written permission:

  • Use or share psychotherapy notes, except in limited cases allowed by law.
  • Use your information for marketing purposes.
  • Sell your information.

Communications With You

We may contact you by phone, text, or email for appointment reminders, scheduling, and treatment-related communications. You may ask us to use a different method or address. Text and email are not always secure, so please tell us if you prefer another way to reach you.

Family and Friends

With your permission, we may share information with a family member, friend, or other person you identify who is involved in your care or payment for your care.

Substance Use Disorder Records (42 CFR Part 2)

Because we provide substance use disorder (SUD) treatment, your SUD records are protected by federal confidentiality rules (42 U.S.C. 290dd-2 and 42 CFR Part 2) in addition to HIPAA. This section explains those added protections. Where Washington law is more protective, we follow Washington law.

One consent for treatment, payment, and operations. You may give us a single written consent that covers all future uses and disclosures of your SUD records for treatment, payment, and health care operations. For example, this consent lets us send treatment information to your health plan so it can pay a claim. You may revoke your consent in writing at any time. Revoking it does not undo anything we already did based on it.

Uses that need your written consent. We make uses and disclosures not described in this notice only with your written consent. Two kinds of consent must stand alone. A consent to use your records in a civil, criminal, administrative, or legislative proceeding against you cannot be combined with any other consent. A consent to share SUD counseling notes, which are a clinician’s separate notes analyzing a counseling session, also needs its own form. For example, we need your written consent before we share your records with your employer.

Sharing without your consent. We may disclose your SUD records without your consent only in these cases:

  • Medical emergencies.
  • Scientific research that meets federal requirements.
  • Audits and evaluations of our program.
  • Reports of suspected child abuse or neglect as required by Washington law.
  • Public health authorities, only when the records are de-identified under HIPAA standards.
  • Business associates and qualified service organizations that help us run our program, under written agreements.
  • Other limited cases allowed by 42 CFR Part 2, such as a crime on our premises or against our staff, or a court order that meets Part 2 requirements.

Legal proceedings. Your SUD records, or testimony describing them, cannot be used or disclosed in any civil, criminal, administrative, or legislative proceeding against you unless you give specific written consent or a court issues an order that meets Part 2 requirements. Where federal law requires it, a court may order disclosure only after you or the record holder receives notice and a chance to be heard. The order must come with a subpoena or similar legal mandate before we release any record.

Redisclosure. When we disclose records under your consent for treatment, payment, or health care operations, the receiving Part 2 program, HIPAA-covered entity, or business associate may redisclose them as HIPAA allows. Even then, the records cannot be used against you in a legal proceeding without your specific consent or a qualifying court order.

Fundraising. If we ever use your records for fundraising, you will be given a clear opportunity to opt out first.

Your Part 2 rights. You have the right to:

  • Ask us to restrict disclosures of your SUD records that you consented to for treatment, payment, and health care operations.
  • Ask us not to share records with your health plan for a service you paid for in full out of pocket.
  • Receive an accounting of disclosures of your electronic SUD records for the past three years, once that federal requirement takes effect. You also have the right to an accounting of other disclosures made with your consent.
  • Receive a list of disclosures made through an intermediary, such as a health information exchange, for the past three years.
  • Opt out of fundraising communications.
  • Get a paper or electronic copy of this notice and discuss it with our Privacy Officer.

Breach notice. The same federal breach notification rules that apply to your other health information apply to your SUD records.

Complaints. You may report a violation of Part 2 to us, to the Secretary of the U.S. Department of Health and Human Services, or to both. We will not retaliate against you for filing a complaint.

Your Rights

You have the following rights when it comes to your health information.

  • Get a copy of your records. Request to see or receive an electronic or paper copy of your medical record. Send us a written request. We will respond within 15 working days. If we need more time, we will tell you why in writing and give you a date no later than 21 working days after we received your request. We may charge a reasonable, cost-based fee as Washington law allows.
  • Ask us to correct your records. Send us a written request if you believe information is incorrect or incomplete. We will respond within 10 days. If we need more time, we will tell you why in writing and give you a date no later than 21 days after we received your request. If we deny your request, we will tell you why in writing, and you may add a statement of disagreement to your record.
  • Request confidential communications. Ask us to contact you in a specific way or at a different address. We will agree to all reasonable requests.
  • Ask us to limit what we use or share. We are not required to agree, except when you pay for a service in full out of pocket and ask us not to share that information with your health insurer. For SUD records, you may also ask us to restrict disclosures you consented to for treatment, payment, and health care operations.
  • Get a list of those with whom we have shared information. Request an accounting of disclosures for the six years prior to your request, with certain exceptions. For SUD records, you may also ask for a list of disclosures made through an intermediary for the past three years.
  • Get a copy of this notice. Request a paper copy at any time, even if you agreed to receive it electronically.
  • Choose someone to act for you. A person with medical power of attorney or a legal guardian may exercise your rights.
  • File a complaint if you feel your rights are violated.

How to File a Complaint

You may file a complaint with our Privacy Officer using the contact information below. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, at 200 Independence Avenue S.W., Washington, D.C. 20201, by calling 1-877-696-6775, or by visiting hhs.gov/ocr/complaints. We will not retaliate against you for filing a complaint. Filing a complaint with us does not stop you from also filing one with HHS.

Consumer Health Data Privacy Policy

If you contact us or use our website before you become a patient, Washington’s My Health My Data Act may protect the health information you share. The act covers information that HIPAA and 42 CFR Part 2 do not. Our stand-alone policy explains what we collect, why we collect it, who receives it, and how you can use your rights. You can read it in full on our Washington privacy rights page.

General Provisions

This section covers added Washington protections and other terms that apply to all of the information above.

Washington State Health Care Information Law

In addition to federal law, we comply with the Washington Uniform Health Care Information Act (RCW 70.02), which gives extra protection to mental health and substance use information. When Washington law is more protective of your privacy than HIPAA, we follow Washington law.

Security

We use administrative, physical, and technical safeguards to protect your information, including encrypted connections, access controls, staff training, and HIPAA-compliant vendors. No system is completely secure, but we work to protect your information against unauthorized access, use, or disclosure.

Breach Notification

If a breach of your unsecured protected health information or your substance use disorder records occurs, we will notify you without unreasonable delay and no later than 60 days after discovery, as required by HIPAA. We will also notify the U.S. Department of Health and Human Services and, where required, the Washington State Attorney General.

Record Retention

We keep health records for the periods required by Washington law and professional licensing rules, and securely destroy them when no longer required. Website inquiry data is kept only as long as needed for the purposes described above or as required by law.

Minors

Our programs and website are intended for adults. Under Washington law, minors age 13 and older may consent to certain outpatient mental health and substance use disorder treatment, and in those cases the minor controls access to related records as permitted by law. We do not knowingly collect information from children under 13 through our website.

Text Messages and Calls

If you give us your phone number, we may call or text you about your inquiry and care. We ask for your separate consent on our forms before we send text messages. Agreeing to texts is optional, and it is not a condition of getting care. Message frequency varies. Message and data rates may apply. Text messages are not always encrypted, so please do not put sensitive details in a text. Reply STOP at any time to opt out, or HELP for help. We do not share your phone number with third parties for their marketing.

Nondiscrimination and Language Assistance

Clarity Healthcare complies with applicable federal civil rights laws and Washington law. We do not discriminate on the basis of race, color, national origin (including limited English proficiency and primary language), sex, age, or disability.

We provide reasonable modifications and appropriate auxiliary aids and services, such as qualified interpreters and information in alternate formats, free of charge and in a timely manner, to people with disabilities. We provide language assistance services, including oral interpretation and translated documents, free of charge and in a timely manner, to people with limited English proficiency. To request any of these, call (206) 339-0233 or email contact@teleclarity.org.

Our Section 1557 Coordinator is our Clinical Director, (206) 339-0233, contact@teleclarity.org, 1818 Westlake Ave N, Suite 201, Seattle, WA 98109. To file a grievance, contact the coordinator. Grievances may be submitted by phone, email, or mail, and we will review them and respond in writing within 30 days.
